These terms apply to our portrait studio and purchases from darlingpetstudio.com. The product description, selected options, order total and delivery information shown before payment form part of your order. Mandatory consumer rights take precedence over these terms.

Creating and approving your portrait

Our portraits are created with AI from the photographs you provide. They are artistic interpretations, and physical products are prints of the approved artwork. They are not individually hand-painted originals.

You can view a watermarked preview before purchasing. Check the faces, markings, composition and other details before selecting that portrait for your order. A preview is not a promise that every generated result will suit you. Your approval does not waive rights concerning an item that is defective, incorrectly supplied or materially different from what you ordered.

Product images may show illustrative frames, rooms or scale. Your purchased size, material and frame are the options identified in your order. Screen settings and printing can cause reasonable colour differences; this does not excuse a material mismatch or a printing defect.

Your photographs and permissions

You must be an adult able to enter a contract, or use the service through an adult responsible for the purchase. Upload only photographs you own or have permission to use for this purpose. If a photograph includes another person, you must have the necessary authority and permissions. For a child, obtain permission from their parent or legal guardian. Do not upload unlawful, abusive or infringing material.

You retain your rights in your photographs. You give us the limited permission needed to process them, generate and display previews, fulfill your order and provide support, including through our service providers. This permission does not allow us to use your photographs or portraits in advertising without separate permission. Personal-data use is explained in our Privacy Policy.

We may reject unlawful uploads or suspend misuse of the service. Restrictions on abuse do not remove valid rights attached to an existing paid order.

Products, prices and payment

The selected product specifies whether you are buying a digital download or a physical print. A physical purchase does not include a separate digital download unless the offer expressly says it does. Framing is included only when selected.

The checkout shows the currency, selected items, applicable taxes and total before payment. Standard shipping for physical portraits to supported destinations is included in the product price. Any optional delivery upgrade must be separately identified and accepted.

Payment is processed through Shopify and the payment method you select. We send an order confirmation after checkout. If an item cannot be supplied, we will contact you and refund any payment for the unavailable item; we will not substitute a materially different product without your agreement. Changes to these terms or prices do not retroactively change an accepted order.

Digital portraits

After payment verification, we provide access to the purchased portrait file. The digital portrait is supplied as a JPEG file. Contact us before purchasing if you need to confirm compatibility or suitability for a particular print size. Save a copy on your own device. Purchased digital portraits can be downloaded again without a time limit, subject to verification of the order and lawful access controls. A cancelled or fully refunded order loses download access; a partial refund alone does not remove it.

You may use your purchased portrait for personal purposes, including personal printing, gifts and sharing. Commercial resale or distribution requires separate permission. We do not promise that AI-generated elements qualify for exclusive copyright protection or that no other generated image will resemble them. Rights belonging to other people remain unaffected.

Delivery, cancellation and remedies

Our Shipping Policy and Refund and Cancellation Policy form part of these terms. They distinguish made-to-order physical items from digital content. Nothing in them removes mandatory remedies for defective goods, non-conforming digital content or failure to deliver.

Responsibility and disputes

We are responsible for fulfilling our obligations to you, including where a print or delivery provider performs part of the work. We do not exclude liability that applicable law does not permit us to exclude. No promise in these terms removes your statutory guarantees or access to remedies.

Please first send any complaint to hi@darlingpetstudio.com with your order reference and a description of the issue. You retain the right to bring a claim before a competent court.

French law governs these terms, subject to any mandatory consumer protections that apply in your country of habitual residence. This clause does not require you to give up a court or remedy available under mandatory law.
