Who controls your information

What we collect and why
We process photographs you upload, the portrait options you select, generated previews and purchased artwork to provide the portrait service you request. We also process session identifiers so you can return to your studio and selected portraits. This processing supports steps you ask us to take before a purchase and performance of your order. If your photographs include other people, provide them with this notice and obtain the necessary permissions before uploading.
For purchases, we process contact details, billing and shipping information, selected products, payment status, order references and delivery updates to process payment, supply the order and provide support. Shopify and payment providers handle payment credentials through checkout; we do not need your full card number to create a portrait.
Support messages help us answer questions and resolve complaints. Security and operational records help prevent misuse, protect accounts and diagnose failures, based on our legitimate interests in running a secure service. We retain records required for tax, accounting and other legal obligations on that legal basis. Optional marketing and non-essential tracking require the permissions applicable to your location. Declining optional marketing does not prevent a purchase.
Who receives information
Our current service uses the following providers for the relevant functions:

Providers may have distinct legal roles for parts of their service. Their own privacy notices describe processing they undertake independently. We may also disclose necessary information where required by law or to establish or defend legal claims.
Shopify and your shopping information
Shopify hosts our store and checkout and processes information about your use of these services. Shopify may also process data independently for its own services and enhanced features, as described in its Consumer Privacy Policy. You can exercise rights concerning Shopify’s own processing through its Privacy Portal.
For applicable choices about sharing data for targeted advertising, visit Your privacy choices. You may contact us about access, deletion or other rights, including through an authorized representative where permitted. We will not discriminate against you for exercising your privacy rights.
Photographs, previews and visibility
Original uploads and full-resolution masters are stored privately with access controls. To show the selected portrait at Shopify checkout, we create a small, watermarked copy accessible through a public image URL. Someone holding that URL can view that copy. It does not contain the original upload or the full-resolution master. Please consider this when uploading images of people.
We do not use your photographs or portraits in public advertising without separate permission. Our use of OpenAI is through its API. Provider processing and security retention are described in OpenAI’s API data documentation.
Storage periods and international processing
We retain purchased digital masters to provide repeat downloads without an expiry date, subject to lawful erasure requests and order-access controls. Removing an artwork at your request may prevent future downloads; we will explain that consequence. Other retention decisions depend on the information involved, the service requested, outstanding order or support needs, legal record-keeping requirements and the establishment or defence of legal claims. Closing a browser session does not itself erase stored photographs. Contact us to ask about information held for your studio or to request erasure.
Our providers may process information outside your country, including outside the EEA or UK, where data-protection laws may differ. Contact hi@darlingpetstudio.com for information about the processing and transfer arrangements relevant to your data.
Your choices and rights
Depending on applicable law, you may request access, correction, erasure, restriction or portability of your personal information, object to certain processing, and withdraw consent without affecting earlier lawful processing. Contact hi@darlingpetstudio.com. We may ask for proportionate information to verify the request. Some records must be retained to meet legal obligations or defend claims; we will explain relevant limits.
You may complain to the CNIL in France at cnil.fr or to the competent supervisory authority where you live or work. You can unsubscribe from marketing through the message's unsubscribe option, where marketing is offered. Order and service communications are separate from promotional messages.
Our service is intended for adult customers. Adults uploading photographs of children must have the necessary authority. Contact us if you believe a child has submitted information without appropriate authorization. We will publish material updates to this notice and provide additional notice where required.
